Legislation and policy to social work with children and families

The legislation that underpins this case study is the Children Act 1989 it is:

“An Act to reform the law relating to children; to provide for local authority services for children in need and others; to amend the law with respect to children's homes, community homes, voluntary homes and voluntary organisations; to make provision with respect to fostering, child minding and day care for young children and adoption; and for the connected purposes”.

This Children Act 1989 is pertinent to this case study because there are various factors that need to be considered. The act sets out guidelines such as addressing Jacek's well being and safety, and emphasising the concept of parental responsibility his education well being and safety, as well as his education. Under this act, the children act 1989 is paramount as well as the parents statutory obligations, considered under section. Under section 17 of the Children Act 1989, the Framework for the Assessment for Children in Need and their Families provides a framework which looks at a holistic approach to Jacek's child development needs, the parents, parental capacity and family environment.

The consideration would be made for Children Act 1994 because under section 10 and, 11 these sections provide a legal basis for the Common Assessment Framework and Multi-Agency working. The associated guidance, for example, the Every Child Matters (ECM) would also be considered because the school at times provides Jacek lunch and this policy would ensure that Jacek's well being, looked after. The Children Act 1989 sets a president as one of the National Drivers for Change in England. However, in Wales, Children and Families' (Wales) Measure 2010 have two primary responsibilities. These include sections 66 and 6. Both of these are requirements for local authorities, health bodies and professionals. It contracted to them to consider, when assessing or treating an adult, the need to identify any children whose welfare may be compromised or at risk and to consider providing support and referral to children's services. As Jacek and his family are individuals in their own right. The consideration would be made for Human Rights Act 1998, because it is there to protect the rights of Jacek and his parents. The rights and freedoms set forth in this convention shall make secure without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, and association with a national minority, priority, birth or other status (Paul, 2001, 16).

A consideration would also be made for Education Act 1996 (section) in the Children Act 1989. In conjunction with The UN Convention, the Rights of the Child under Part 2, Article 2 will protect Jacek's 'Right to an Education'. The Children Act 2004 would be considered because of section 10 and 11. From research, it recognised that the amendment made, to the Children Act 1989, now includes impairment suffered from seeing or hearing the ill treatment of ...
