Introduction

Injury usually refers to an injury sustained, which may be physical or emotional pain and suffering, damage to reputation or dignity, loss of legal right, contract, or damage to movable or immovable. The civil law is to compensate victims of wrongful acts, whether intentional or unintentional, for damages that could reasonably be expected from such acts. In a personal injury claims, the types of damages the injured party may recover are: loss of earning capacity, pain and suffering, medical expenses and reasonable. It includes both present and future expected losses (Simpson, 2002).
