To What Extent Crime Is the Product of a Broken Society?

Introduction

The successful development of civilization requires the existence of a space of freedom within which individuals are given various opportunities to express themselves, including not only the aspirations of up to ideals, but in the opposite direction, the path of violation of social taboos. Durkheim says plainly: in order to exist in society to express themselves for the idealists and romantics, the heroes and martyrs, it is equally possible to exist as self-expression and for criminals. Freedom cannot exist if there are no opportunities deviations in different directions - and the ideal, and in the opposite direction of the denial of the ideals and standards (Wikström & Sampson, 2006, pp. 125-150).

In any system there is always destructive and disintegrative start. For the social system of one of these sources is the disintegration of the crime. It causes the system to remain in a state of operating voltage and prevents it. Crime, according to Durkheim, is not only implies the existence of paths open to necessary changes, but in some cases directly prepares these changes. Where there are crimes, collective sentiments are sufficiently flexible to take a new shape, and crime sometimes helps to determine what form it will take those feelings and it may be a decisive step for the upcoming changes, including new forms of morality of the future. Confirmation of this idea Durkheim saw in the story of Socrates' trial and execution. The offenses for which Socrates was condemned by a court of Athens, proved useful as heralded a new morals, and were a prelude to the coming changes. So it was in the next century, and many heretics, innovators (Wikström & Sampson, 2003, pp. 110-115).

And the measure of the severity of punishment for them would be the same as if it were a real crime. It should not be regarded crime as a social disease. If the level in a civilized society does not pass a certain threshold of acceptability and acquires the character of social pathology, it should be considered a normal social phenomenon (Passas, 2007, pp. 47-96). The Social Laws of the Evolution of Punishment

Two criminal penalties of the law of evolution" are formulated and discussed two principles; the effect of determining which way affected the historical evolution of criminal penalties. The first one scholar has called "the law of quantitative change," the second - "the law of qualitative change (Parcels, 1996, pp.41-45).
