Introduction

The purpose of this paper is to analyze and interpret the case of Maria who has been complaining regarding the unfair promotional policy of her organization. Maria claims that accent discrimination refers to discrimination of the employees that cannot speak English with proper accent. Under the law, everyone has the right to be free from employment related discrimination based on certain grounds. These laws generally prohibit employment-related discrimination based on someone's accent. It would be illegal not to hire someone because of her accent, for example, but discrimination could also occur any time a person is treated differently in the workplace because of her accent. Discrimination is permitted if it is based on a bona fide occupational requirement (Dovidio, Gluszek, John, Ditlmann, Lagunes, 2010). This means the requirement is essential for the person to perform the job.

In addition, the company claims that Maria has she has been accused for aggressive behavior in the organization which is not true. On the other hand, the organization asserts that the workforce of the organization has been complaining about Maria's behavior. When Maria was asked explanation, she said that she has certain family issues due to which she becomes aggressive some times. Hence, it became an easy choice for the organization to reject Maria and acknowledge Alex for the higher designation. Nevertheless, this is a debatable issue and would be catered in the light of distinct sources.

Evaluation of the Situation

According to the analysis of the situation it can be interpreted that the promotional policy of the company is debatable. The analysis of the scenario clarifies that there were several factors that were responsible for the selection of Alex for the promotion. These factors influenced the promotion of Maria on the advanced designation. The analysis of the case reveals Maria as a person that belongs to Latino ancestry. In this scenario, Maria has filed a complaint that she was unfair promotion of Alex that has been granted to him by the officials of the corporation. The core reason enlightened by Maria in this scenario is her accent due to which she has been eliminated from the higher designation consideration by the officials. Maria admits that she has distinctive accent; however, her performance and dedication towards the work has been exceptional according to her.

The officials of the organization report that Maria had fewer performance appraisals to add value to its evaluation. The lack of performance from the Maria's perspective was linked with her behavior in the workplace. The higher authorities of the organization in this scenario assert that Maria was governed by aggressive behavior in the workplace which is unacceptable.
