Ethical Issues in Criminal Justice System

Introduction

The fact to obey orders and or laws is sometimes unwise to issues of ethical behavior. It does not mean that violations of law or regulations should be ignored. An ethical dilemma is a situation in which there is no morally acceptable solution and that the only rational solution is detestable, though less worse. An ethical dilemma is a moral conflict between apparent moral imperatives, that is to say that obedience to a requirement would result in the violation of another moral imperative (Amicis, 2005). In this paper four scenarios will be analyzed against the ethical and moral issues and right decision will be proposed for each.

Scenario # 1

As the chair of the parole board, Robert holds the position of an important position and authority. He is responsible for determining whether the board should deny or grant liberty to the individuals. Owing to this fact he does not only have to follow the basic requirements of law but he also have to ensure that his actions and decisions are based on basic ethical considerations (U.S. Department of Justice, 2010). Parole board often faces challenges from other public officials, such as the legislators. In this situation, Robert is also facing from advocates who are concern about the safety and other matters of prisoners that is affecting by the overcrowded prisons. They are threatening the corrections system with lawsuits. On the other hand, releasing more inmates might create ethical issues for the society, as the results of risk assessments show that the released inmates might reoffend. Owing to this fact, Robert has to be prepared for provide useful information which may satisfy the arising concerns. As a chair of the board, Robert has the duty to make his nation proud through conducting his duties in a way that may halt any ethical or moral concerns (U.S. Department of Justice, 2010). Thus, he has to spend much time while considering hid decisions about resolving the issue of overcrowded prisons. Performing his duty responsibly and honestly while considering the welfare of public has now became motivation for him to act as fast as he can.

As the risk assessment shows that, early release of inmates may increase the chances of re-offending but he has to make decision of releasing them early so that the capacity can be increased for other prisoners. Owing to this fact, he has come up with a solution which will make sure the early release of inmates along with such implications which will ensure the protection of ethical problems related to this issue (U.S. Department of Justice, 2010). The biggest issue faced by the release of inmates is the possibility of their re-offending. So he has come up with the Conditional Post-Conviction Release Bonding.
