European Convention on Human Rights: Article 10

The European Convention on Human Rights also known as ECHR was first drafted in the year 1950. It is an international treaty and its purpose is to protect the human rights freedom. This paper will critically analyze the article 10 of the draft (Kokkinakis, 2006, Pp. 291-427).

Article 10 of this draft states that 1) everyone has the right to freedom of expression. This right includes freedom of opinion and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting companies, television or cinema and 2)the exercise of these freedoms, duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties provided by law and necessary in a democratic society in the interests of national security, territorial integrity or public safety, for prevention of disorder or crime, health and morality, the reputation or rights of others, for preventing the disclosure of confidential information or for maintaining the authority and impartiality of justice (Eylem, 2003, Pp. 55-91).This statement is both inconsistent and ambiguous and because of this fact it creates difficulty in implementation and interpretation.

The first part talks about the freedom of expression and how people are free to express their opinions. They are free to acknowledge information or give out information. They won't have any interference whatsoever from the authorities. They are subjected to share and voice their opinion legally and lawfully according to this draft (Alexandrite, 2008, Pp. 124-345).
