This article offers the new definition of modern federal immigration power. In late nineteenth century, Supreme Court and Congress fundamentally transformed federal government authority to regulate immigration, the kind of commercial regulations firmly rooted in Congress trade power, the power that is tied to Constitution derived from country "inherent sovereignty", and subject to common judicial deference.
