Introduction

In this paper, we will present a feasibility report on the Planning & Building Regulations for constructing homes in West London. A farmer has appointed us to draw up feasibility plans for rental holiday cottages on his farm land with the view to sell them as family homes in the future. He has seen this type of project successfully carried out by other farmers in his area. The farmer does not know what the legal obligations are and does not understand why he should require Building Regulations approval for the development. The climate change issues through the UK sustainability policies encourage a further 20% reduction in carbon dioxide (CO2) emission rates.

Hence, we have to prepare the feasibility report in which we have to address the regulations of planning and building home according the policies of the United Kingdom. Like this farmer, many people have now realised that they might require the approval for the building work which they have already projected; however, people do not really comprehend the differentiation among the planning permission and building regulations. Both of them are different parts of the legislation process. There is a possibility that people who want to construct a building would have to write applications for both the consent of the building regulation and the planning permission.

The regulations of building deal mostly with the safety and health issues for the security of the people who would use the building. In other words, this regulation is concerned with how the buildings are constructed with reference to:

fire safety

structural stability

site preparation and resistance to moisture

sound resistance

toxic substances

hygiene

ventilation

heat producing appliances

drainage and waste disposal

conservation of power and fuel

protection from collision, falling and impact

facilities and access for disabled people

electrical safety

glazing safety

These are the legal requirements which ensure that the accurate standards are met. The Building Control Officers of the council are the ones who deal with the regulations of building applications.

On the other hand, the planning permission works with the land use, buildings appearance, considerations of landscaping, access to highway and the impact which the development would have on the environment. Officers of the Town Planning Council work on the applications of planning and listed buildings, and conservation areas and orders of tree preservation. If there is a requirement of the planning permission, it would be wise to wait till the permission is granted before submitting the application of the building regulation.
