Introduction

All us non-smokers have had it happen to us, we've sat in a designated non-smoking area of a restaurant when suddenly there is cigarette smoke lingering in our direction. Forcing us to believe how this meets the criteria as the non-smoking section. Current researches have shown that implementing a smoke-free ordinance might possibly boost the overall restaurant or bar sales. Smoking must be allowed with restriction; it must be permitted in designated regions only at the workplace, and not be tolerated at all in the dining/entertainment area of bars and restaurants.

Discussion

Despite over thirty years of Surgeon General's warning on cigarettes, over 430,000 Americans die each year from smoking related deaths. Smoking is the number one preventable death in America, but it is the individual's right to do what they desire. Though, in current years there has been a sharp increase in the number of smoking bans. California, for example, prohibits smoking in all restaurants and most workplaces for which most of them ran into losses (Proctor, 2007). In New York City, restaurant owners complain that restrictions hurt their trade. Any individual who essentially goes to NY bars as well as clubs is aware that the ban is tremendously unpopular and causing all types of issues, awful vibes', and noteworthy loss of trade (Lader, Henningfield & Jarvis 2005).

Why the Empire State Restaurant and Tavern Association would be suing the city if trade were booming. Staff whom the ban is supposed on to protect, hate being the cops, and for less tips. Some lose their jobs as smaller bars go out of trade. Even jukebox companies are protesting, because individuals are standing out on the street smoking instead of feeding their machines. Several bars defy the law and let individuals smoke, but they all have to display a notice with a phone number to call 'to report violations.' In other words, it is to 'rat on' your neighbors (Dearlove, Bialous and Glantz, 2002).

A current research by The Substance Abuse Policy Research Program, admittedly an anti-smoking group, shows that restaurants were not hurt after the NYC bans. The latest annual report of Philip Morris shows us that it ran it a huge loss because of the ban in New York alone. The statistics shows that the net worth profit came down crashing by 10% almost (9.9% being precise).

The profit went down from 38,486 to 34,872 compared to 2003 and 2004.This gives us a better idea of the damage in the national budget (Bayer, Gostin, Javitt and Brandt 2007). Those few opposed to the limitations have argued that bans are a violation of civil rights.

The right to individual liberty is one of the basic tenants of the U.S. justice system, but not to the point where that liberty inflicts on the freedoms of others.
