Introduction

Terrorism stands at the evolutionary peak of the expansion of Western criminal law systems. This evolution contradicts many of the constitutional foundations of Western criminal law, to the extent that a real “criminal law” for enemies appears on the equivalent horizon of penal legislation. The basic argument here is the idea that criminal law is an effective instrument to fight against terrorism. A thorough analysis reveals that this overstates the preventive capacity of the penal system. To the contrary, given the communication strategy embodied in terrorism, an irrational overreaction could be quite dysfunctional for the objective of fighting terrorism: in particular, and notwithstanding the fact that it does not provide a real solution to preventive terms, it may cause a contamination effect that could modify the constitutional foundations of the overall penal law system. Moreover, the terror of State, exercised by a state against its own nationals or the conquered communities, is sometimes seen as a form of terrorism. Rather than conducting military purposes, the goal of terrorists is the spread of panic in the community on which violence directed. Consequently, the community coerced to act in accordance with the wishes of the terrorists. Terrorists often seek the destabilization of a state by causing as much chaos as possible, through a radical transformation of the existing order. Terrorism is specifically designed to have far-reaching psychological effects beyond the immediate victims or object of the terrorist attack." (Martin. 2003, pp. 23-31)

Islam is the religion of peace, but that does not accept oppression. Islam teaches that one must do our utmost to eliminate tension and conflict (Kelsay, 2002, pp. 91-99). Islam promotes peaceful means to bring about change and reform. In reality, Islam emphasizes that we must strive to eliminate evil through peaceful means without resorting to force as much as possible. In the history of Islam from the Prophet - peace be upon him - until now, Muslims have, in most cases, resisted oppression and struggled for freedom by means peaceful and nonviolent.

Islam also teaches proper ethics in war. War is permitted in Islam, but only when other peaceful means such as dialogue, negotiations and treaties fail. War is the last resort and should be avoided as much as possible. Its purpose is not to convert people by force, or to colonize people or to acquire land, wealth or fame of any ...
