Introduction

The law which regulates the citizens' relation when violated, the person can be called as criminal. In the past care was given to treat the crime and not the criminal. Only the gaolers and the executioners were there to treat the criminals. The effects of the judge verdict were also not known both to the judge and the criminals.

This issue was brought to light by the Italian Jurist, according to him confession by the criminal through torture and on the basis of it giving verdict was not the right action by judges. The classical school of thought felt that people were free to act and that they did felonious act only to seek pleasure. So the only way to keep them away from the offences was to punish them according to their offence severity. The modern school of thought was more into curing the problem and felt that criminal action was caused by internal and external factors, which were not in control of the criminal. This school of thought emphasis is more on curing than on punishment. According to the writer criminals have various anomalies in skeleton, face and sensitive function. So they closely resemble the uncivilized races. These anomalies had a close relationship between the savage and criminals, and those illicit activities are atavistic in origin.
