Synopsis

Before analyzing the impact of recent legislation on civil liberties and human rights, it is necessary to establish the parameters of our civil liberties and human rights as they existed before. Only then can measure any impact. What are our civil liberties? How different from our human rights? Where are these freedoms and rights enshrined? To what extent are protected and to what extent they have been eroded? Reference to historical development is essential to any national spirit, if any, in connection with our rights and freedoms must be identified.

Purpose of the Research

The purpose of this thesis to investigate and analyze the true strength of our "democratic" principles and beliefs. It is recognized that the field of civil liberties and human rights covers a huge area. It is my intention therefore to concentrate on four specific areas that may be deemed to impact on the lives of most citizens.

Research Questions

The Convention for the Protection of Human Rights grants rights and fundamental freedoms, including the right to liberty and security (Article 5), the right to a fair trial (Article 6), the right to privacy (Article 8) and the right to freedom of expression (Article 10). It is based on these four fundamental freedoms that I will try to measure the democratic health of the UK.

After describing the historical development of rights and freedoms in relation to the areas identified, I will try to highlight the factors that motivate that were responsible for development along with the factors that are considered relevant today.
