Introduction

Tort accountability is a staple of edification law. Government protection usually guards schools from most concerns of legal responsibility. There are exemptions — which show a discrepancy from area to area. To that end, it is incumbent on legal representatives to gain knowledge of how the elements that must be confirmed in negligence situations relate to schools, on teachers and other concerned players to comprehend these rudiments to predict potential accountabilities and avoid those (Elliott & Quinn, 2001). This paper will assess the potential liability (carelessness or other torts) of the various parties involved in the given case study.

This case study shows full of carelessness by various parties. Bobby and Rachel were playing basketball on the school ground with a new backboard and rim fixed by ACE Sports. So this new apparatus was fixed by ACE Sports and this is their liability that Bobby was hurt. If an incident is rooted by a faulty item, the company and supplier is together legally responsible even if the Bobby does not recognize which one was not careful in creating the product or exactly how the defect occurred . Also they were in the school ground, so the school establishments should abide by the safety measures regulations, and make sure school tools.

As one can observe Rachel was also a good exemplar of negligence, he was not conscious of the first aid regulations and this is the liability of the school. Rachel even did not have any initiative to take Bobby to the First Aid Box .As it is acknowledged by The Healthcare and Safety (First Aid) Rules that put a wide-ranging responsibility on the School to make satisfactory First Aid Box available for all staff, in case they got injured or become ill at workplace. Each School is requisite to offer suitably stocked First Aid Boxes to alleviate the dangers of unpleasant incidents or injuries that could occur from school activities.

A teacher's duty of concern also links with the excellence of guidance offered to the learners. Rule 298 needs educators to be accountable for effectual training, guidance and assessment of the development of students in the sports activity (Harpwood, 2009). Unproductive training and guidance can cause serious damage to learners particularly to those participating in sports activities that have the possibility to put them at danger.
