The case I have chosen for the purpose of this assignment is the Case Example D which relates to the Zoom Car Company. Daniel Boone bought a car from Zoom Car Company which had a faulty compass resulting in serious consequences for the owner. The most prominent underlying legal issue related to the case is the breach of agreement. The contract law between Daniel Boone and the Zoom Car Company is not completely fulfilled by the Zoom Car Company by providing a faulty feature. Moreover, the Sales of Goods Act has also been violated. It is important to consider that Zoom Company has not provided Daniel with the faulty feature intentionally; however, the losses to Daniel Boone are because of the product of Zoom Car Company that is why it raises several legal issues (Dawn et al 1996).

Plaintiff's Arguments

Daniel Boone possesses extensive and strong arguments to support his case. The first and foremost aspect that supports the argument of the plaintiff comes out of the Sales of Goods Act. The Sale of Goods Act is a provision that creates a legal binding between the buyer and the seller of any product that is covered under a contract. Customers like Daniel Boone possess many rights in the situation when they are not happy with the products, but usually customers are unaware of their rights. Daniel Boone can claim for damages caused by the faulty compass feature of the car (Dawn et al 1996).

There are certain conditions that every seller needs to make sure before transferring the products to the buyer. The quality of car being sold must have been focused by the Car Company.
