Introduction

The ace of globalization and mobilization is continuously changing. The legal process of sentencing criminal to death as a part of their criminal punishment is entitled as Death Penalty. These criminal offenses that result in death penalty are also known as capital offenses or capital crimes. There are many nations in the world where such legal processes of penalty has been practiced and observed. There are only fifty eight (58) countries that are actively practising death penalty in their particular states (Smith, 2011). On the contrary, there are other ninety seven (97) countries that have dismantled the conventional practices or traditional activities of capital punishment. In many countries, there are only rare cases of using the death penalty such as at wartime (Delfino & Day, 2009). It has become a huge controversy in many different states as many national are liable to it and some states refuse to incorporate it across the legal system. Death penalty is a punishment which has been awarded to safe individuals from committing serious crimes. It has been used as a source of fear for people to live a particular code of life according to demands of rulers. Human rights urged many countries to abolish such serious type of punishment. This research paper assesses to determine whether the death penalty is an effective form of punishment in the United States.

Description

This serious form of criminal punishment has been argued against civil justice and social norms that require discontinuity. Human Rights share standpoint as upfront protest against capital punishment with a demand for global change in the way criminals are punished (Delfino & Day, 2009). The legal form of punishment ensures that commitment of serious crimes needs to keep away from society and requires an intense social manner in the society.

History

The inception of the United States shows the existence of capital punishment. Death penalty is a part of the constitution of the United States from the colonial to the constitutional period of 1987, right through the present day. There were 15000 people who have sentenced to such intense punishment from the enforcement of this law. The era of the year 1900 to the year 1950 has shown most execution of the death penalty. U.S. Supreme Court has enforced the constitutionality of the death penalty from the period of 1967-1977 (Howell, 2010). The practice of capital punishment was as unpredictable after the court declaration as it violates the law enforcement against cruel punishments. The assessment of penalties enforced the constitution of the United States to revise their laws against this criminal conduct. Capital punishment or the death penalty has taken a different course after the commencement of the new millennium.
