Introduction

Drug test can be defined as the examination of any biological sample, whether it is a blood test or urine test. As time progressed, many different methods evolve with the time to test the fragments of drugs in the human body. Drug intake, directly relates to economic conditions or it can even relate to the personal and environmental issues around the individual. However, major uses of drug testing are to evaluate the presence of performance ornamental drugs majorly used by the sports men. However, in the context of this paper we will analyze the justification of drug testing among the employees (Zeidner, 2010).Many researchers believe that with the passing of time it has become extremely important for companies to test their employees for the presence of drugs, as many as one-third of the American companies have now adopted the practice to test their employees for a drug test.

This drag test, however, can be taken at any moment, or any time during the job or before the hiring process as it relates directly to the performance of the individual which will ultimately result in effecting the overall performance of the company. In my opinion, it justifies to test the employees for a drug test not only ethically but constitutionally. The supreme court of the United states of America has ruled in favor of the drug testing as completely acceptable infer the laws of the land. This clause does not only apply to the companies operated in the public sphere but also for those companies who are operating in the private sector. This ruling of the Supreme Court has helped develop the culture of drug testing among the American companies or it will not be wrong to state that it has provided the base to establish the drug testing culture in American corporate arena.

Legal Aspects

Many in the country still tend to argue regarding the fact that drug testing by no means tends to justified in the context of the company's working and framing the policies which tend to cater such aspects of the society (Charles, 2007). The legal section holds the perspective that, it is constitutionally applicable on each and every company operating in the domain of the American corporate arena. As per the common law, which tends to, rest in the form of “employment at will”, this requires the correct interpretation of the law in order to develop the complete understanding regarding it. As per the spirit of this law it is quite clear that any of the party either the employee or the employer has the rights to conclude the agreement if not stated in the contract which tend to be signed before joining the company. It involves the employer to bring an end to any employee's stay with them if violated any clause of the contract, and many companies have now adopted to randomly testify their employees under the protection of this law or I must say ...
