Equality before Law

Abstract

Equality has considered as an aspect of freedom. According to the needs of the present society, it is important to focus on shallow equality instead of deep equality. Every individual is equal in front of the law and the issues faced by ethnic minorities are mainly due to the lack of meaningful integration.

Equality before Law

Introduction

Every individual is equal in from of the law (www.judiciary.gov.uk). In this essay, the extent to which this statement is reflected in practice is determined. the understanding of deep and shallow equality has been provided to determine the level of equality which is required. It is followed by the effect of antidiscrimination law on the black people in terms of their employment and wages to help understand the effect of antidiscrimination law. The meaningful integration of the migrants has also been identified as a solution to increase the effectiveness of antidiscrimination laws.

Discussion

The difference between the right and the left, conservative and progressive in politics is mainly the difference in terms of the relative weights they place for freedom and equality. The progressive and leftist are those that give high priority to social justice, fairness or equality while the liberals or conservatives place emphasis on the freedom. This identification is due to the confusion that exists between the deep and shallow equality or freedom. In the design of democratic, economic and social institution, deep freedom takes priority over aver any type of equality of circumstance. The equality in terms of opportunity is considered to be a fragmentary aspect of freedom (www.judiciary.gov.uk).

Act of Equality, 2010

An act has been introduced in UK legislation on the basis of which the Ministers are required to exercise their duty of reducing the different socio-economic inequalities at the time of making strategic decisions. it also emphasizes on reforming, harmonizing the law of equality along with restating the larger postion of the legislation in terms of harassment and discrimination that are related to the personal characteristics of a person. It also emphasizes on enabling some employees to get the information published regarding the differences in the female and male employees. It also prohibits the victimization in some situations along with the need to exercise some funcstions for eliminating the discrimination and other forms of conduct which is prohibited. It also emphasizes on increasing the opportunity for equality and change the laws which relate to the responsibilities and rights in the relationships in the family (www.legislation.gov.uk).

Institutional Conservatism

The socialist and liberals of 19th century have considered equality as an aspect of freedom. Their main commitment has been to empower both species and individuals for the formation of greater self and humanity. They differed in terms of the understanding of the institutional formulas and the greatness to which they have linked their hopes.
