First Amendment Rights to Free Speech Freedom of Speech

Abstract

America is known for being the “land of the free and the home of the brave” (Key, 2010) according to our national anthem, the Star Spangled Banner. This song brings out the pride and patriotic feelings that we shared with our founding fathers. However, to some, our civil liberties, such as the freedom of speech, have caused them to push the limits of the Constitutions First Amendment's clause on our freedom of expression during speech and the right to be heard. The purpose of this paper is to explore those rights, to define them and to question: when does the freedom of speech go too far or is there such a thing.

Introduction

American First Amendment on Freedom of Speech was created in 1791 (Baker, 1977). Aim of this clause is to prohibit the government from banning speech because it does not agree with the message. This amendment ensures against the governmental instruction that based on the essential personal freedom such as freedom of press, freedom of religion, freedom of assembly, freedom of expression and freedom of assembly. The establishment of this clause prohibits the government from passing different legislation to establish an official religion or preferring one religion on another. This amendment also enforces that the separation of state and church. There is some governmental activity that relates to the religion has been declaring constitutional by Supreme Court. According to White, (1996) the more basic and more important component of the freedom of expression is the freedom of speech. This allows individual to express themselves without any constraints or interfere by government. The court has furthermore determined that the First Amendment provide less security to commercial speech, offense, speech that damaging to children, speech broadcast on TV and radio, the speech that enjoy most broad protection of First Amendment may be focus to time regulations, place and expression manner that is intently customized to serve a important government attention (Baker, 2002). In addition, the most extensive speech that enjoys protection of First Amendment may be controlled on the beginning of its content when constraint has pass. This report provide an general idea of the main outcomes from the First Amendment of the ways Supreme court has interpret freedom assurance of speech and push to provide no defense for some types of speech. Such as there is no protection for child pornography or support of the use of power or law infringement.
