Flexible Forms of Employment

Introduction

The experience of developed labour markets indicates a growing concern of employers to find suitable staff to carry out specialized tasks. This occurs both in business, government and private sector. The current state of the labour market is increasingly pointing to deficits number of skilled workers, especially those with high skills, meet the needs of employers. Problems with the valued employees of employers are not always the consequence of earnings, but also stem from the work environment.

The employer is interested in the worker's availability, even at higher costs. In these circumstances, problems often arise, which are often derived from the commitment of employees to the family, the need to care for children or other dependents (e.g., parents, grandparents). Similar problems arise in situations where because of the expectations of customers is necessary to extend the working time of establishment or individual consultants.

The employer faces a dilemma of how to resolve these situations? There are several possibilities (Vermeylen, 2007, pp. 313-317):

may change the employee, to hire more dispositional, then you lose an experienced employee, his skill, and often his contacts, costs of apprenticeship a new person is usually very high and long-term,

can convince the employee that he devoted himself to the expense of other commitments,

May introduce more flexible working to allow the worker to combine family responsibilities with work.

Many companies have already introduced new regulations to the work rules in order to maintain the relationship with employees, which have already invested significant resources. Also in the legal regulations in many countries, solutions for flexible forms of employment are used, such as: telecommuting or working split (job sharing).

The legal solutions in many countries are not yet fully adapted to the model solutions, but on the basis of already existing rules, an employer may introduce flexible employment instruments. These agreements were developed in accordance with applicable law. They ensure the employer is able to fully enforce the employee's duties, and employees give any guarantees concerning employment law. Through its flexibility also allows us to work on those who do not take the norms of traditional work in general, will work without a guarantee in writing (in black) and will work on contract for work or having to rid themselves of employee rights. In the next section, we will critically discuss the extent to which flexible forms of employment can be seen as a win-win situation for both employers and employees (Rutkowski, 2003, pp. 17-31).
