Legalizing Same-Sex Marriage

INTRODUCTION

The marriages of same-sex is emerged as a realism in the United States since 2004 in the ruling time of the Supreme Court of Massachusetts and it was regarded as the clause of equal protection in the Constitution of state. Before 2012, the marriages of the same-sex became legalized in NYC, Iowa, Connecticut, New Hampshire, Washington, D.C. and Vermont. But just Maryland and Washington State approved the laws regarding marriages of the same-sex and no one could take implementations of it instantly. Generally, in the election which was recently held on November 6th, 2012, the voters have approved Maryland and Maine ballot measures to legalizing marriages of same-sexes in such states, with still questioning still being expected in Washington (Posner, 2003:145).

The marriages of same-sexes have been legalized by the legislative actions and court rulings as well as through voting. Such marriages have been prohibited by nine states and thirty states prohibit it through their state's constitution. The (DOMA) Defense of Marriage Act, which was enacted in the year 1996 works for preventing the federal government to recognize the marriages of same gender and slowing it in every state for refusing appreciation of such marriages which are performed in all other states. DOMA has been declared unlawful by eight different courts of federal government including two appeal courts of federal. The Justice Department of Obama administration has agreed regarding this law by considering it as unconstitutional and has refused to protect it. But most of the people in the U.S want that the federal government must pass a constitutional amendment for legalizing the gay marriages.

SUMMARY OF OPPOSING POSITION

Some Advocacy groups went through the debate of marriages of the same sex in current years. Such groups are (NOM) National Organizations for Marriage and (FRC) the Family Research Council which are working by designated hate groups by the Southern Law Centre of Poverty. HRC which is the Human Rights Campaigns consider as among one of the best groups in advocacy for supporting the marriages of the same sexes. As per their website, a lot of couples with the same sexes demand for the rights to marry legally and lawfully as they love each other and spending their lives together since last 10 to 20 years and now for honoring their relationships greatly they have to offer with some public commitments by their society after that, they could be able to stand together in their good and bad times and all the challenges and joy which a family life carry (Velde, 2005, p. 256).

In the United States, opponents of the same sex marriages ground their argumentation on the concerns of parenting, religious, and other concerns that tend to change the real meaning and definition of marriages as it would then lead to the incest or polygamy, as well as some other intellectually accepted ideas which are expressed in the theory of natural law.
