Legislative Process

Introduction

The paper attempts to discuss the concept of legislative process in a holistic context. It aims to highlight the key points of legislative process and also emphasis on the legislative process of the U.S. The parliamentary stages of a legislative process, which are the subject of this chapter, are the last links of a much longer process that begins with the proposal, the formulation and drafting of a congress as well as the presidential meeting. This paper discusses the steps a legislative process including all the details of key terminologies before it proceeds to explaining the legislative process of the U.S. in a comprehensive and concise manner.

Discussion

The Senate and House of Representatives are organized by the majority party in each chamber, which elects its President, the Majority Leader and the Chairs of each committee (Mikva & Lane, 2009). For much of American history, the party controlling the White House controlled the House and Senate; a situation could lead to the development of laws and increasing of the presidential vetoes of bills that are passed by the Congress. Unlike the heads of the government in the parliamentary systems in other countries, the president of the United States of America does not resign and new elections when the majority in Congress rejected their programs (Sinclair, 2007).

Congress has broad discretion in domestic affairs, among which are the taxation, the loan request and payment of debt, coinage and regulating its value as well as regulates trade between states Federated (Keefe & Ogul, 2001). Congress helps in establishing as well as monitoring the government departments and agencies of the executive. If the Electoral College fails to provide a majority for one of the presidential candidates, Congress elects the president from the three highest numbers of votes. Senate President of the United States of America is after the Speaker of the House of Representatives in the line of succession to the presidency (Mikva & Lane, 2009).

The Legislative Process

The series of steps followed in order to develop or modify a law or decree, known as the legislative process (Mikva & Lane, 2009). This process is carried out under the following: the proposed law or decree, the Commission turned over to the opinion, for further discussion, approval and sanction in the room full, and publication in the official newspaper to make it law (Keefe & Ogul, 2001).

Law

Is an act of authority that has as an element to create rules establishing individual behavior in society and inherent elements of abstraction and generality (Voermans, 2010).

Decree

Comes from the Latin "decemere, decrevi, decretum" meaning agreement or resolution. Is the decision or determination of the head of state on any matter in his government, which creates specific standards and personal (Keefe & Ogul, 2001).
