Racial profiling, also called ethnic profiling or "Racist profiling refers to the actions of police, security, and immigration and customs officials if it is based on general criteria such as race, ethnicity, religion, and national origin of a person. Critics demand that suspicion should be based only on the behavior of individuals and on objective evidence. The Racial profiling is an act of institutional racism. The term comes from the American criminology.

Racial profiling occurs:

In the fight against illegal immigration, identity checks at train stations, airports, trains and in the border area with people who outwardly have a foreign appearance.

In the fight against Islamist terrorism, identity checks of visitors Mosque or "Muslim-looking" people and in accordance motivated dragnet.

In cases where law enforcement action against ethnically defined usual suspects, such as in the USA increased controls of black vehicle owners.

The case provided here does not qualify as a case of ethnic profiling because of the fact that Detective James McFarland arrested Jackson and Rodriguez based on evidence that he found in the form of a gun that was illegal to carry (Shusta, Levine & Wong, 1995). Moreover, the actions of the two citizens were also suspicious which led James McFarland to believe that these men might be planning to do something wrong and when they both were found to be carrying a gun and were not able to get themselves identified before the detective, arresting them was the only option that was left with James McFarland. Calling this action racial profiling is not right, because James McFarland arrested the two men because of the suspicious actions, they were doing and because they clearly were carrying, a weapon that even might not be licensed to them.
