CHAPTER 1: INTRODUCTION

Background of the study

In the terrorist attacks of 11 September, 2001 United States Congress passed a legislation for strengthening and uniting America through providing it appropriate tools that were required to obstruct and intercept Terrorism Act of 2001 is commonly known as “Patriot Act”. This paper will help in highlighting the legislative issues that were found in the Patriot Act related to criminal justice. The USA Patriot Act was introduced to bring immense legislative changes for enhancing the investigative and surveillance powers of law enforcement agencies in providing protection to Americans. Terrorism is a severe issue that should be stopped from the society. The civil rights were undermined even with the enactment of USA Patriot Act, as it was not able to provide protection to Americans.

The purpose of introducing this act was not only to limit the access of the terrorists in the society but also to provide protection to people living in United States of America. The paper will initially speck about the violations that were made in the Fourth and First Amendments along with the lack of check and balance in accordance with USA Patriot Act. The Americans faced alarming situation on 9/11, 2011, as they never thought about it ever. On that day, the nation was made aware of the loopholes that were present in the US security. Several changes took place in the law enforcement activities of the security providing agencies since 9/11 attacks. The Patriot Act mainly focused on bringing security in the society.

With the help of moral, philosophical and origin arguments for ensuring the right to privacy is one of the key factors that will be considered under this study. It is equally essential for us to analyze the aspects of the society that is creating conflicts with the right to privacy and criminal justice under the USA Patriot Act.

Problem Statement

The USA's Patriot Act was not only unconstitutional but some of its provisions have nothing that would help in protecting the Americans from the dangers of terrorist activities that were observed in the society on 9/11. This paper will help in highlighting the loopholes that are found in the Patriot Act related to criminal justice assistance. 9/11 attacks made the American nation frightened that; if proper and effective measures were not taken can create great hurdles in the way of nation's prosperity and integrity. The Bush administration introduced USA Patriot Act legislation, within less than a week time because the administration was criticized for not keeping effective security controls. The version of the Patriot Act that was introduced by The Senate was quite similar to the request that was made by the Attorney General John Ashcroft.
