Legal and Statutory Requirements that apply to Room Division Operations

There are several legal and statutory requirements of the room division operations. These include the provision of hygienic food, providing lodging that does not in any way harm the guests, the conduct to be maintained by the staff, the provision of emergency first aid to guests, fire safety, registration of complaints, and several other requirements that must be obtained before the company can begin its business (Ross, 2004, 523-544).

There are laws that regulate the opening, classification and requirements necessary for the management of accommodation facilities in the region. The text of the law is complemented by various directives to define the characteristics and minimum requirements for each type of structure, as well as the minimum requirements for the classification level for listed facilities (hotel facilities, outdoor facilities, houses and apartments for vacation and optional classification for furnished apartments for tourist use) (Barth, 2008).

There are some specific legal requirements for furnished property or bed & breakfast, motels, spa, beauty farm, village-hotel, convention centre, popular hotel, spa hotel and residence time. These are very different to outdoor accommodations such as camps, and resorts. Outdoor accommodations are not open to the public, picnic areas for temporary parking, occasional business accommodation and breakfast. Other kinds of accommodation such as furnished apartments for tourist use (Coleman, 2000, 145-157).

The owner or manager of the room division must give prior notice to the city for every variation of the elements contained in the authorization or what was declared in the beginning of the certified activities. They should also provide accommodation exclusively in accordance with the state laws relating to public safety. For tax purposes, the manager of the rooms division should communicate the data regarding the accommodation provided and the movement of customers to the provinces and submit the rates charged. They should also provide a certain degree of insurance to the guests (Mills, 2008, 28-41).

The following are some of the legal and statutory requirements of the operators of the room division:

Registration: The owner or operator of the facility must be registered with the State. These operators include operators of bed and breakfast and management of furnished apartments for tourist use if carried out in a non-entrepreneurial and without the provision of additional services. They must also meet the requirements of the regulations concerning public safety (Tanke, 2001).

Structure: The structure in which the activity is pursued must comply with all regulations, requirements, approvals on construction, town planning, sanitation, public security and fire prevention, as well as those on the intended use of the premises and buildings.
