Abstract

The research paper aims to describe the health care regulatory processes in the state of Tennessee. In case of a misconduct or incompetency, the process of complaining and the role of regulatory agencies are highlighted. The importance of respecting the liabilities of patients is described along with the need of the risk management as well as the quality assurance strategies to ensure liabilities. The process to file a case against the health care profession is explained.

Introduction

The Health Care division of the Board provides all the administrative support for the councils, committees, and one registry, which are charged for the regulations and licensure of the health care professionals, and to acknowledge Office of the Consumer. The board has as mission to safeguard the health care rights of the Tennesseans by registering the health care professions whose practices meet the standards of qualification. These standards of practices are interpreted by the board through the laws, regulations and rules. The board is responsible to investigate the violations in practices, according to the Practice Act. It is also responsible to licensee professional, for any violations (Department of health, 2013).

Registration

The Law of Tennessee mandates that the health care professionals have to submit their information details to their specific department regarding their training, specialization, practices and certification (Department of health, 2013).

Credentialing

Credential verification is used obtain and verify the details of health care professionals in order to evaluate the information provided by the professionals (NAIC, 1996).

Licensing

The state law requires that the health professionals should hold the license. In Tennesseans nurse professional need masters degree or national certification in order to qualify as a nursing professional. The certification of national specialty should in appropriate area of specialization (Jones & Bartlett, 2005).

Certification

The certification is required to provide health care benefits by means of policies, which is an agreement with the board to offer, deliver, and arrange for reimburse any costs related to health care services (NAIC, 1996).

The Complaint Process for Patients

The medical standards of Tennesseans do not accept any malpractices or deviation from the standard practices. The malpractices include causing injury to patient, providing false information, drug abusing, and fail to continue the education for future requirements. In any of these cases the patient can complaint against the professional for incompetence or misconduct. The process for complaining involves the following steps.

A number is assigned to all the complaints received

These complaints are reviewed by the Supervisors and Secretary of the board.

If the complaint is not sufficient to take any legal actions against the professional, the board sends a letter about the complaint that it has been closed.

If the complaint is sufficient to take action against professional the board secretary and supervisors investigates and gather information related to the complaint, which is then assigned to the attorney of Enforcement ...
