Introduction

Internet is indeed one of the most effective inventions that the world has received in the past decade. It has played a vital role in bringing the different parts of the world closer to each other. However, it has posed a variety of threats on the users and the ones who tend to misuse it for their personal purpose that may harm the others. According to Goldsmith & Wu (2006), the courts have become active to catch some cases and establish their verdict in order to suppress the encouragement of such practices. In the past few years, there have been numerous cases of different nature in which the court has taken decision according to the exposed situation. This paper tends to discuss three cases of three different aspects as to give clearer picture of the decision pattern that is flowed by courts. The verdicts in these courts are further serve as foundations for the rest of the upcoming cases.

Case 1

In a case of “Cubby, Inc. vs. CompuServe Inc., 776 F. Supp. 135(S.D.N.Y. 1991)” the plaintiff was Cubby, Inc. that field a claim for damages that was inflicted due to one out of numerous users of CompuServe on different forums. The journalistic forum generated electronic gossip named, “Skuttlebut” in which there was an offensive comment against Cubby Inc. CompuServe did not review the content before publishing. The court established its finding that CompuServe had a position equivalent to a distributor. The verdict was passed on the basis of case in which United States Supreme Court that a distributor should have knowledge about what is being published on their forums. The company will be responsible otherwise and so the CompuServe was held responsible for the infliction that was caused due to defamatory. ...
