Should “Victimless Crimes” Such As Prostitution And Other Sexual Activity Between Consenting Adults Be Free From Governmental Interference?

Abstract

In this study we have explored the crucial topic of victimless crimes in a detailed manner. We have investigated the victimless crimes through a number of aspects which includes detailed history of prostitute legalization, explanation of the scientific changes and methodologies, critical analysis of the successes and failures, advances in technology and the limitations of evidence, etc. The study revealed that there are positive impacts of victimless crimes on law enforcement activities. The study concludes with the predictions on the importance and limitations of prostitute legalization.

Chapter 1: Introduction and Statement of the Problem

Introduction

Victimless crimes, which are also known as consensual crimes, are defined as crimes in which no one is hurt; in other words, there is no direct victim because individuals choose to participate. These are mala prohibit crimes, that is, they are crimes because the state has said so and not because they are behaviors that are inherently evil (Butler, 1985). They include the following: gambling, substance abuse (particularly individual substance abuse), prostitution, obscenity and pornography, and the failure to use safety devices (e.g., seat belts and helmets). In some instances, homosexuality and abortion have also been considered victimless crimes.

These crimes occupy a huge amount of criminal justice attention and taxpayer dollars, with more than 4 million arrests nationwide each year. This leads to more than 350,000 persons serving jail time and additional 1.5 million persons on probation or parole. For many of these crimes, the victims and the perpetrators are one and the same.

Prostitution means the carrying out sexual acts against payment. If the involuntary prostitution, one speaks of forced prostitution. Prostitution is found in virtually every culture. The social assessment of prostitution is dependent on cultural, ethical and religious values and is subject to substantial change. There is a distinction between the female and male prostitution (Morse & Simon, 1999).

This topic has many problems, but, the problem we are going to focus is “Should 'victimless crimes' such as prostitution and other sexual activity between consenting adults be free from governmental interference?”
