Background of the Case:

A family, Mr. Smith the father, Mrs. Smith the mother, and Mary Smith their 14-year-old daughter, live in your state. For the past several years, Mr. Smith has been sexually abusing Mary. While Mrs. Smith was aware of this, she felt powerless to do anything about it since Mr. Smith viciously beat her every time she threatened to report his conduct. Finally, after one particularly horrible event, Mrs.Smith escaped and went to the local police and reported the crimes. Mr. Smith was arrested for child and sexual abuse, as well as for domestic violence. While the case is pending, Mr. Smith convinces Mrs. Smith to reconcile with him. Mrs. Smith tells the prosecutor that she won't testify and won't allow Mary to testify.

Apt Actions for Case 1:

Mr. Smith should not be allowed to reconcile with Mrs. Smith and his daughter considering the fact that Mrs. Smith had already warned Mr. Smith numerous time about her reporting about the hideous crime that he was doing to his daughter to the police but Mr. Smith consciously threatened Mrs. Smith and continued to abuse his daughter therefore it shows that Mr. Smith was doing the crime intentionally to please himself. Considering that besides threatening Mr. Smith he did not listen to his wife then there is a higher probability that Mr. Smith will not improve and continue to do it so after a specific time span and the only reason based on which Mr. Smith is asking for reconciliation is the fact that he is scared of the punishment that will be enforced by the law (Karmen, 2003).

Since Mrs. Smith is refusing to testify then I as a prosecutor will have to implement Subpoenas that is via a writ I will compel Mrs. Smith to give a testimony by ensuring that there is a witness as well as production of evidence. If it is not productive then I will ensure that I implement Subpoena ad testificandum where Mrs. Smith will be asked to produce evidence or face punishment. It is necessary since Mrs. Smith making decisions under emotional influence (Christie, 1986).

Being a prosecutor, Megan's law should be enforced whereby the name of the sex offender should be made available to the public so that the public is safe when Mr. Smith is released since Mr. Smith's family is not going to accept him after the damage that he has induced. Sex offenders still have the urge to satisfy themselves and hence they will make a move on who ever that he comes across. I will ensure the fact that complete information in relation to Mr. Smith should be disseminated which should include his complete name, the date of detention the prisoner had, the kind of crime that has been committed. I will also ensure that the information is easily available to the public websites. I will ensure the fact that information is not only available on specified websites but also newspapers that are commonly read along with flyers ...
