CHAPTER 5: CONCLUSION

Overview of the Study

The new wave of violence and harassment has been increasing as a topic of discussion for various research and academic studies. Bullying is an aggressive form of violence that is more prevalent in United States. This study discusses various case laws and court based hearing that has violated Title IX of the Educational Amendments and Title VI of the Civil Rights Act. These both legal acts highlighted different qualitative tools such as Empirical Legal Studies and four pronged test to understand social imperatives of such highly influencing social evils among children in schools and colleges. Bullying is one of the most derogatory and socially evil forms of aggression that has been rooted in individuals in order to challenge each other for the survival and intense competition. This research study is based on the gender-based student-on-student harassment that violates the Title IX of the Education Amendment of 1972. The study uses secondary sources of different legal documents, theoretical studies, case laws, and published articles to structure the need for the background study. Bullying is behavior that is by choice. Thus, this study also comprehensively evaluates different characteristics, classifications, factors, and consequences of bullying.

World Health Organization has worked on academic literature on gender based bullying in their publication Violence Prevention: the evidence which is fundamental part for the background study of this research. It explains bullying as violent and aggressive phenomena that is widespread among academic institutions (mostly public schools) such as schools and colleges. This study highlights trends and analyses from different publications and reports from the year 1980 to the year 2009. Peer reviewed scholarly articles and academic research writing for the span of last twenty years are included to understand the systematic and recurring influence of coercion, force or power among young children in schools. Sociological theories, large-scale surveys and legal case studies are used as research approach for this study. Examples from case laws and real life experiences are included as a subject of study that has been witnessed by most of the adults during their life at schools. This is the first and literary part of this multidimensional study. The next part follows violations of clauses and statutes of gender based bullying under Title IX of Education Amendment of 1972. This second part of this study is the function of legal jurisprudence about punishment and reinforcement for incidents and cases of bullying. Research background highlights about three core concepts of this paper. These concepts include academic research on bullying, Title IX on the Education Amendment of 1972 and its enactment and implementation in academic institutions. The study comprehensively evaluates history of Title IX and amendment in Title VII of the Civil Rights Act of the 1964.
