In this article, the crime and violence that exists against women is considered to be deeply rooted in the patriarchal society of India. In order to analyze the article properly, it is very important to understand the concept of patriarchy. The article is provided in the appendix section. Patriarchy is a type of social system in which the father is considered as the head of the family and he has supremacy in the family and also has the legal dependence of the children and wife. This type of social system is considered to be a male dominant society in which the women are oppressed. The dominance of father is seen as supremacy and the concept of patriarchal family is considered to be the core of male domination's systematic process. The patriarchal society is a type of hierarchical society which consists of both generational oppression and sexual oppression. It is because the males dominate the females in patriarchal society and the older men dominate the younger men. The impact of patriarchy has reduced in the western countries because of laws relating to education, abortion and divorce. The main reason for it is that patriarchal society has an unequal distribution of different rights in the society and the women are underrepresented in higher posts. Some scholars have viewed the patriarchal system as the result of the capitalist system and class system. Therefore, when these systems will be destroyed, the female population will gain power. Many of the radical feminists consider the patriarchal system as a form of male power which is focused on female oppression. This shows that the system of patriarchy in families is the main starting point of male domination and subordination by female is all aspects of life.

According to Botello, patriarchy is considered as a violent force that men and the male dominating organizations follow. He further said that, violence against women is not because of all the men but it is the duty of all men to take initiative to end it. In the patriarchal system, the males control almost everything. Therefore, these men should takes initiative to end violence to which the women are subjected. This can be done through proper rules and legislations that the law can set and then ensure that these rules and laws are obeyed by all the people and failure to do so will result in punishing them.

According to a lawyer that specializes in the areas of women and criminal law considered the violence against women as the greatest scandal of human rights. It is because the women are oppressed, forced to have abortions, harassment due to the demands of dowry and the many incidents of rapes. All these issues are faced by the women in the patriarchal society because the men who commit these crimes are not punished by the law.
