Criminal Justice Authority Evaluation

Abstract

Crimes committed all over the world, and the history of crimes is as old as the history of law enforcement. Previously, law punished a criminal in the presence of local community, so as to deliver a lesson of decorum and prohibition from criminal actions. By the enforcement of law in society, a proper structure of rules, written down along with the punishments as circumstances of breaking that law. In this paper, we will discuss and evaluate the criminal justice system, its components and its implications or influences on the society at large.

Introduction

The government system or intuition responsible for developing and maintaining social decorum, deterring and mitigating crime, called criminal justice. This system empowered by the government and structured by law enforcing agencies has the authority to sanction penalties to those involved in violating state law, and also responsible for the rehabilitation process. The accused have the right to be protected against any abuse during the investigation process. The operation of criminal justice is under the discretionary authority, which includes the court system, law enforcement agencies and corrections.

Criminal justice system consists of three major sections, Legislative, adjudication and corrections. The legislative consists of the police department that makes sure those laws, implemented in the society and taking measure against violations. Adjudication consists of law courts, where settlement of presented disputes is on the basis of state law. Courts consist of critical personals including, the judge, and the prosecutor and defense attorney. Lastly correction authorities represent s the facilities where accused when found guilty, presented for asylum and commencement of sentence. This includes the jails and prison in the state and the enforcement of law in these facilities (Gibson, B, Cavadino, P, & Faulkner, D. 2008).

Discretionary authority in legislation

Legislation represents the police department of the state to enforce police laws. Warranted police officers or the law enforcement agencies have the authority to use force and lawful coercion against the general public. The primary concern of the police department is keeping the peace in the state and enforcing criminal law; however, there are various other functions that the police department performs. The discretionary authority enjoyed the department of police is the authority to make decisions on whether to charge a person with a crime or not. The law clearly defines those actions that are criminal in nature. They are also responsible in taking their decision as to what charges should be placed on criminal actions. Full discretion is problematic, because of various factors; therefore, most agencies adopt only few policies. On the basis of functionality, two types of enforcements are commonly adopted.
