Introduction

The problem question is about the event organized by the Fresco supermarkets, in order to celebrate their centenary. The event resulted in disaster with panic and mob-mentality, several people were got killed and injured during this event. There are several legal and factual issues involved in this problem question case and the problem question falls under the “Tort Law”. Tort law is a law that deals with reparation of damage. But nevertheless, at times, when the repair thereof is difficult, the law allows the injured party redress through compensation for the damages incurred. This legal obligation to compensate the damage or repair the damage generated in the bound, typically, the mood never to commit the act which led to the damaging event, under penalty of again in wrongful conduct that led to the need repair. The study will “Analyze the potential liabilities arising and/or possible remedies available in tort of all the parties mentioned”.

Brief background and issues involved in the problem question

The Fresco supermarkets, organized and event to celebrate their anniversary, and in the end the event turned out to be a disaster and resulted in the death and injuries of several peoples. The event was covered by a live- televised exhibition and 'Play Day' with celebrities in the local park in Nottingham. The centerpiece of the exhibition is a huge hot air balloon bearing the Fresco's logo, and lottery tickets are sold offering the prize of a ride in the balloon across the countryside. Because toys and free gifts and the balloon ride had been advertised for weeks, a large crowd appears in the Park and the police, informed of the event by Fresco's executives, and already suspecting big numbers of people, have insisted on erecting barriers to control the entrance and exit gates of the park, and also cordoned off access to the balloon leaving only a narrow gap for the winners to get through on takeoff.

As the raffle ticket numbers are read out identifying the lucky winners, an excited crowd surges towards the air balloon. The advertisement of the event was quite successful and it attracted a large crowed and the security arrangement were not adequately made with the presence of security barriers, fences and the overall the security and management of the event was managed by the police department itself. There was no emergency plan for the event.

Excess people get in to the Hot air balloon, the capacity of the balloon was 10 people and 25 people get in to the balloon which indeed resulted in the crash of the balloon.
