Introduction

The issue of public safety is one of the issues of greatest importance when considering the role of the state in society (John, 2005). Along with factors such as health, education and employment, public safety is an indicator of the quality of life of citizens. In this respect, Criminal Law, supported by the Criminal Justice System, holds a prominent position when it comes for not only punishment, but also the prevention of crime, in order to protect a legal right, and we need to prevent it from being damaged (John, 2005). However, although some scholars of legal sciences can relegate to the penalty function of preventive criminal law, there are many controversies about the real purpose of the sentence. Moreover, a sound public safety policy should be formulated on the basis of data provided mainly by the Criminal Justice System, which will enable the understanding of the causes of violence and, as a corollary, the implementation of measures best suited to the Brazilian case.

Discussion

There is no way justify a security measure and decide on an approach without state information about the types of crimes most frequent places where they occur, who are the main victims, who are the main offenders, among others (Todd et al, 2010). However, the mere pursuit of the causes of violence can not lead to an efficient outcome, because the crime is a complex social phenomenon, which can be determined by a number of social, cultural, economic or internal character of the individual.

Other theories have emerged about the purpose of punishment, but in much resembled those mentioned above and were, of course, very similar criticisms.
