Under the Double Jeopardy clause of Fifth Amendment, the American State and Federal government cannot re- prosecute the defendant for the same offense who has already been convicted or punished by the Court but it's applicable to those legal proceedings that take place in criminal courts as it doesn't include civil court proceedings. This law was created a century back in USA. (Vile, 1992)
