A Committed Crime



Abstract

This paper explains the rights of a defendant, the process of conviction and the pronouncement of a sentence in the modern Court of Law. It shall be working on a case study, extracted from a reputable news source. It will highlight all the process and investigations that will influence the final decision. It shall also come up with two sentences based on the collected evidence in court.

Introduction

The modern code of law is written by all intents and purposes to be impartial and fair to both the defendant and the prosecutor. Since the ultimate objective is the prevalence of Justice, both parties are given equal credence and fair hearing. Rules and regulations have been established the respect the rights of the charged so that they are not exposed to any mistreatment or mis-conduct of the authorities. Similarly the authorities are also required to operate within a certain area of rules like respecting the charged party's right of silence, his supplication to searches, maltreatment during detention, etc.

The Court observes everyone “Innocent until proven guilty”. The victim, goes through a complex process of arrest, trial in court, deliverance of the charges, a chance to defend himself and lastly the delivery of a sentence in which can either be charged and penalized (from fine and community service, to lifelong imprisonment or even death by hanging).

The Fifth Amendment dictates that no person shall have to answer for a crimes unless infront of a grand Jury or will be persecuted twice for the same crime (double jeopardy)

The Sixth Amendment states, all prosecutions, the accused has the right to appearing in court in the State where he has been penalized. He shall be informed why he is charged, convinced of his crime and free to bring witness to prove his innocence.

Finally, the Eighth Amendment states,
