The Global Movement towards the Abolition of Capital Punishment

Introduction

The opinions of societies on capital punishment were very different in recent years. Some people think it is the cruel and inhumane procedure, while other part of society believes that person who killed other person should be punished same way, with help of most severe form of punishment. Each crime has its own level of seriousness and on this level of courts to choose type of punishment for criminals. But in twentieth century, society's view on this type of punishment changed much, "Nations of all political stripes ended their use of death as punishment for murder and other crimes" (Ogletree and Sarat 2009, p. 1). People thought that capital punishment not only violation of human rights, but also unconstitutional and cruel form of punishment. This essay focuses not only on abolition of capital punishment, but also in global movement towards abolition.

Discussion

Schabas said that "in Worldwide Assertion of Human privileges to life is supreme law has been described, one of important rights, most fundamental of all rights ..." (2002, p. 8). The United Nations Charter, which was adopted in aftermath of war in 1945, and provided the number of recommendations for human rights and freedoms. Yorke provided some evidence on this subject, this Charter states that "promote and encourage respect for human constitutional rights and essential freedoms for all without peculiarity as to race, gender, language or religious conviction," and this is considered main reason for process of abolishing capital punishment (Yorke, 2008, p. 10).

That is why violation of current law can be considered cruel and humane, not person is free to choose lifestyle, conditions and situations may be different. It is desirable that each person living in modern society and care for future of this nation to implement abolition of capital punishment in all countries. And maybe in future such future process will be conducted throughout world. Some countries are still against abolition of capital punishment, but will not change their attitude to such procedure in future may become isolated in modern society at international level, as countries today days increasingly reflect this type of cruel and unconstitutional and try to abolish it.

Yorke said that plenary session of UN General Assembly in December 2007 on abolition of capital punishment the "significant number of countries (104) voted in favor, 29 abstained and only 54 were in against ... and 1988, 35 countries had abolished capital punishment "(2008, p. 1). It is also stated that 102 of 112 countries have abolished capital punishment for all types of crimes and circumstances, including threat of war or some serious circumstances. But in this case raises question of what kind of punishment should replace penalty of capital punishment or death and why to use this or that kind of penalty.
