Introduction

Cell phones are such part of everyday life for numerous People living in Florida and all around the world that no one could longer think about dragging wireless telephone out to drive, text or message; it is just natural. Unfortunately, answering cell phones is unsafe when driving. (Beede, & Kass, 421). With mobile phone technology that provides the ability to send text to other phones, talking has gone mobile. Like its predecessor, using cell phone for phone calls or text messages can be very hazardous and dangerous especially while driving, sending a text message from a cell phone while driving a car is more dangerous than driving under the influence of alcohol or drugs. This paper discussed about the Ban Distracted Driving in Florida.

The state of Florida should ban the use of cell phones while driving a car due to the dangers distracted driving.

Discussion

Driver distraction is a major cause of accidents that's why 29 states excluding Florida have passed laws restricting cell phone use to use a hands free device (jurisdiction does not have a total ban). New Jersey and Washington are the only states to ban text messaging while 21 states are considering such bills this year. Currently, Florida has no law prohibiting or restricting drivers from sending text messages or using cell phones while driving. Florida doesn't require hands-free devices; drivers are free to use any kind of cell phone. Suprisingly, 71 percent of Florida residents support legislation to prohibit text messaging while driving. Despite that fact, in each of the last several years, the Florida legislature has considered a number of bills that would ban drivers from text messaging, ban drivers from using hand-held cell phones while driving, or restrict younger drivers from using wireless communications devices (Lissy, 45).

Distracted Driving is reckless driving in Florida, unlike some other states, Florida does not have a law banning cell phone use while driving. However, even without a formal law in the statutes, a distracted driver may be found legally liable to cause a car accident due to negligence. Negligence is not doing what is reasonable under certain circumstances and not paying proper attention. All drivers have other drivers required to operate their vehicles in a reasonable and safe. Proper care requires the driver to concentrate on driving. Using cell phones and other electronic devices while driving significantly decreases the ability of a driver and turn into road conditions. A study in 2009 by Car and Driver magazine found that send and receive text messages on a cell phone while driving can be more dangerous than drunk driving.

Many accidents have been caused by negligence because the driver was texting while driving. There is legislation to prohibit this in many states excluding Florida, but some drivers violate teens still think they can multitask both.
