Thesis Statement

The research paper conducts on a brief introduction and history about banned smoking in USA. It also goes through the effects of banned smoking on the businesses in a positive or negative way.

History of banned smoking: when it started?

Mexican council banned smoking in 1575 in church and colonies. In 1633 it was banned by Ottoman Sultan Murad IV. Pope Urban VIII banned any inhaling of tobacco through any means in 1624. The ban arrived in Europe by 18th century. The first modern tobacco ban was made by Nazi party in every government institution in the country, in 1949. Late 20th century, encouraged USA to create laws banning tobacco. It became a reality in 1975 when Minnesota banned smoking in public places. Firstly, bars were excluded from the act and restaurants were needed to have no smoking zones. But in 2007, restriction on bars was introduced as well. Till date, many states in USA have banned smoking which includes California and San Francisco (Kuneman, 2005).

Law of Tobacco

This law was implemented in 1991 banning tobacco use, i.e. smoking in all the public places which includes public transport, premises, reception, catering places, meeting and training rooms, rest areas, medical facilitation zone and recreational area.

The smoking ban does apply to business?

Banned smoking is implemented on bars and restaurants as well but the businesses are allowed to create a smoking room or a smoking area, where smokers can smoke separating themselves from others.

These are either specific local or space delimited; volume, provisions and conditions of use, aeration and ventilation of the smoking area must protect non-smokers, and finally, these local or spaces must meet a minimum ventilation rate. The smoking out of a location available to smokers can be fined (Elliott, 2004).

Smoking Ban

A smoking ban is an internal regulation or legislation on tobacco which prohibits its use in a specific place, because of its dangers to the health of non smokers, victims of passive smoking. These are most often public places. However, there are also bans smoking in private spaces, including private cars.

Tobacco manage association describes organizations in resistance to smoking or those working for the obligation of strict restrictions on the products of tobacco because of health risks connected with smoking and the possibility of habit that may result. This includes justification for the investigation concerning with the costs of public health affected by smoking and the risk caused by passive smoking (Clark, 2011).

Penalties

Criminal penalties for both employees and employers have been provided. An employee who violates the ban on smoking in enclosed spaces and covered exposed to a fixed fine. The employer in turn exposed to a fixed fine as well if the employer does not put up signs reminding the principle of smoking ban; offers smokers a local non-compliant and promotes knowingly by any means whatsoever violation of the smoking ban (Pampel, 2004).
