Criminal Investigator and Interrogation Process

Introduction

The purpose of this research paper is to discuss the Criminal Investigator and Interrogation Process. The criminal investigation as a process is planned, it is erratic, and the criminal investigator knows what you need, how to find, and where to go to confront assumptions. The criminal investigation is a systematic sequence of steps. Criminal investigator assumes the role of vital importance in the investigation and criminal investigation, because it is responsible for collecting the material of evidence and physical evidence, the prosecution presents research coordinator at trial. An interrogation, unlike the interview, is designed to make a suspect confess his guilt or accept participation in the events. An interrogation of the witnesses can be carried out by the police officers and can ask various questions from the suspected people by taking care of their constitutional rights (Guiora, 2008).

The law gives the prosecutor broad powers to oversee the legality of preliminary investigation and inquiry. The prosecutor is entitled to participate in investigative activities and, where necessary, to make a preliminary inquiry in person or individual investigations in any case to return the case for further investigation, to abolish illegal and unwarranted decision of the investigator and the body of inquiry, to withdraw the case from the body of inquiry and transfer the case from one investigator to another, terminate criminal proceedings, repeal of the investigator to dismiss the case, etc.

Interrogation is one of the most common investigations. It is the means of obtaining, securing, and testing of evidence, witness, suspect, or defendant. The criminal investigation along with the interrogation is a ceaseless activity of continuous analysis and synthesis, i.e. the decomposition of a problem into its elements that comprise it, the analysis of these elements and induction (and inference) are recomposed and interrelate to draw conclusions from them under and through the same process of inference to draw conclusions based on logic and facts (Ward, 1997).

Importance and Role of Criminal Investigation

The importance of the criminal investigation is that the researcher should have the broad and deep knowledge of the development of research, taking into account the appropriate use of resources and the steps to be followed, as appropriate (the offense) to investigate, starting of good planning and coordination in pursuit of proposed results. In the course of a criminal investigation, investigator can perform some administrative functions as the head of the investigation team. He also has the right to give instructions to the bodies of inquiry. Investigator interaction with the operational-search units of the executive power which at the same time is the bodies of inquiry is based on the law of criminal procedure and due process in the form of legal relations (Holland, 2009). The investigator cannot interfere in the organization and tactics of search operations, but may indicate the specific purpose of carrying ...
