Introduction

The criminal justice systems of the countries are different from each other. Moreover, these nations have experienced significant transformations over the period of time. The criminal justice system of United States depends on due process model that places an emphasis on the rights of defendants whereas the system in U.K stresses the function of criminal justice to penalize the guilty (Hostettler, 2008).

There are some differences between courtroom process in England and United States. The structure of England is a system of barristers and solicitors as compared to the informal, at times televised proceedings in U.S. (Cole & Smith, 2009).

Discussion

Following is the analysis of differences in criminal justice system of United States and United Kingdom.

Investigation

In U.S. system, the investigation may involve an exploration of an investigative inspection of an individual or property. The standard of evidence is the probable cause which is compulsory for an investigation. Probable cause is the information or apparent information that indicates the proof of crime can be searched in a particular place.

In U.K. criminal justice system, an individual who believes that a crime has been committed contacts the police. The Police then carry out the complete investigation. In case after the arrest and interview of the individual, the police find the person guilty, that person is charged. A report of the case is prepared and sent to Crown Prosecution Service (Cole & Smith, 2009).

In case CPS finds that the case has a rational potential of success and it would be in the public interest to do so, the criminal proceedings will be stared against the guilt person. In court, the CPS pays the cost or proving, beyond rational doubts about whether the defendant has committed the crime.

Arrest
