Case analysis

Considering the case that occurred a couple of months ago, the U.S. Supreme Court overturned the death penalty child rape in Louisiana. The case overturned the law was that of Patrick Kennedy. One of 43 years was sentence to death for the rape of his 8 year old stepdaughter. He is one of two people in the United States, both in Louisiana, sentenced to death for a violation accompanied by a killing.

In my opinion, decisions in such cases played a crucial part in setting an example for the society in order to discourage such crimes. However, I always thought that having enforced the death penalty for child rape would discourage the individuals to allocate this type of crime. Knowing the consequences of their actions would be the cell of the condemned to death trying to frighten to allocate these horrible crimes against children. As the hearing of the opinion of the court to impose the death penalty in a child rapist actually encouraged killing the victim was something never considered it.

The scenario

U.S. Supreme Court overturned a death sentence for the rape of a child. It found that the death penalty should apply only to murderers. The United States, legislation has been particularly hard against child rapists, often punishable by floor 25 years' imprisonment. Half-dozen states are going to allow their death sentence.

Obama's view on death penalty

"The death penalty should be applied very narrowly defined circumstances, for the most heinous crimes. I think the rape of a child, 6 or 8 years old, is a heinous crime, Obama said. "Moreover if a state decide that, in limited circumstances and defined the death penalty can potentially apply, it does not go against the Constitution."

Punishment Criteria

The punishment just does not mean doing the same; rather it is to punish the offender to curtail freedom with restraint, respecting certain basic parameters show that justice is not lower to the same level of wrongdoing.

Thus, the just punishment respects the right to life and physical and moral integrity of the offender. In prison, the offender may be tortured or eternally isolated from other people, was more atrocious than the crime. Of course, these conditions are not overcrowd prison in Peru where the most powerful criminals decide on the lives of others.
