Introduction

The biggest failure that project managers face is proper planning of agreements that suit the company's overall risks and goals is one of the fundamental reasons why companies face construction over running in time and cost. Promoters employ contractors for the purpose of building their projects in order to meet their respective objectives. Hence it is the responsibility of the project manager to carefully analyze the current situation and identify a construction contract that meets the requirements and the objectives of the company. Before choosing a certain contract it is necessary for the contractor to conduct proper training and evaluation of the situation and make sure to fulfil the following steps; any contractor is required to legally bid for a job that exceeds the state's maximum for unlicensed projects the requirements in order to obtain a contractor's license is similar for any engineer (Wearner, 1989, p.16).

The first requirements are the legal ones which necessitate the applicant to be at least 18 years old and must have a high school diploma. The next factor to consider is choosing the type of contract, according to each city the types and kinds of contracts vary. In order to apply for a contract it is essential that the applicant must have 4 years of experience in the field they are applying in. If you meet all the requirements you will have to give a test in law, business, bid procedures, licensing contracts and topics specific to the equipment, material and codes. The purpose of this paper is to look into two specific contracts and analyze which one is the most appropriate from the development team. The two contracts under evaluation and analysis are NEC3 and JCT SBC 2011. IN order to understand which contract is the most appropriate a thorough analysis and comparison between both has been conducted.

The NEC is an engineering and construction contract which has been developed to meet the existing and the future requirements for a form of contract to be used in the building, engineering and construction industries. This contract is an improvement on existing contract standards in a variety of ways. The object for the design of the NEC contracts was to improve the existing traditional forms of contracts under three major categories:

Flexibility

The engineering construction contract are designed with as much flexibility as possible, it is used for construction work, engineering of any of the traditional disciples; civil, electrical, mechanical and building. The contracts are provided irrespective if the contractor has dull design responsibility or partial design.
