Introduction

Human resource management of any organization needs to consider the legal issues they might encounter throughout the tenure. The employment laws impose major impacts on human resource activities in every organization either related to deferral, local or state legislations. If a company is complied with the legal consideration of the respective state then in result it contributes in increasing the good reputation and the fair functions of the organization which eventually give them a competitive advantage. Although this organization is well complied with different employment acts and laws of the state but recently some incidents of discriminations have been reported in the workplace. It has been reported that employers are involved in such activities that undermine the basic rights of employment and point towards different kinds of discriminations. In order to promote the positive activities in this workplace environment, it recommended to the leadership of the organization that they should implement and maintain an affirmation policy which will ensure equal opportunity employment for every employee. This policy should form such standards which will discourage recruitment on the basis of religion, race, color, cast, creed, disability, national origin or gender. The leadership of this organization also has to ensure that affirmation policy is completely complied with the every opportunity law and regulation which means that every individual possess equal rights to access the self-development. In order to implement an affirmative action, it is needed to know about the affirmative action and the act under which these actions will be taken. In this paper Title VII of the Civil Rights Act of 1964 will be evaluated to examine the human resource management activities of this organization and how its racial discriminatory actions might create a problem for this organization under this particular act.

Discussion

Employment discrimination occurs when an employer prefers some employees on others. It can be due to any reason such as their superior status, friendliness with the employer, racial superiority or gender biasness (Beck et. al, 2002). This discrimination could mean paying less to women employees or to the ethnic employee, ignoring the disabled people despite of being highly qualified etc. There are various kinds of employment discrimination and various laws work against them.

Employment discrimination laws

Employment discrimination laws are the subset of employment laws which protect employees from being discriminated on the basis of nationality, gender, age, race or disabilities etc. It is the duty of federal and state statute to make up the employment discrimination laws. Many HRM activities are witnessed to be discriminatory in different organizations and that are legally prohibited to practice. Such activities include different kinds of bias at the work-place for example transferring, promoting, laying off and recalling of workers, assigning, compensating, classifying and assigning of employees, firing and/or firing of employees, providing fringe benefits training, recruiting, disability leaves and different kinds of harassments (e.g. sexual harassment) (Beck et al.2002).
