Introduction

The purpose of this case study analysis is to expand the boundaries of our knowledge by exploring some relevant facts and figures relating to the case dispute between Faux Stones and Eastern Kitchens. We will write this case analysis in favour of Faux stones enterprises as they are our clients. This case is a contractual dispute between the parties regarding the failure of the technology sold by Faux Stones enterprises to Eastern Kitchen. The other party (Eastern Kitchen) is not satisfied with performance of the machine and the technology (Singer, 1994, pp. 77-89). The other party claims that they potentially face having to pay hundreds of thousands of pounds worth of compensation to people whose kitchens are literally falling down around their ears. This has come about because according to the other party, our client (Faux Kitchen) sold them the technology without checking to see if it would work for the purpose to which they were going to use it. The other party also pointed out that there was no way they could have verified the technology's suitability, given just how limited the information our client disclosed was, and the restrictions our client placed on the Eastern Kitchen in the name of confidentiality (Mentshikoff, 1961, p. 846).

In short, the other party (Eastern Kitchen) expect a fix from our client, and not in the remote future; and they expect our client to compensate Eastern Kitchen for the significant amount of loss they have suffered as a result of the failure of our technology. The Eastern kitchen have asked our client to place their proposals before Eastern Kitchen within a week, failing which they will be forced to place matters in the hands of their solicitors.

In this paper, we will present some factual arguments in favour of our client (Faux Stone enterprises) in order to strengthen our case before presenting it to the legal institutions. In this paper, we will also present the clause of the agreements that we feel are necessary to strengthen our argument (Holdsworth, 1982, pp. 45-56).

Case Analysis

The first evidence that will work in favour of our client is the assessment of the machine from our client's technicians after the complaints regarding the machine from Eastern Kitchen on Novembers 7. Following the complaints from Eastern Kitchen, technical team of Faux stone enterprises have analyzed the deteriorated Faux Stone samples, and I'm happy to say they've discovered the root of the problem. During the site visit on November 7, engineers of Eastern Kitchen were of the opinion that they did not think there was any wrong with the Faux stone granting machine, and they tests bear that out, it is functioning as it should, and the Faux Stone it produces meets the agreed specifications (Cohen, 1998, pp. 106-123).
