Can the torture of those suspected of terrorism ever be justified?

Introduction

Terrorism is not a new phenomena and neither is torture and neither the states action to counter or balamce the human rights and fight terror to safeguard the citizens of the country. History has it that whenever there has been terrorism there has also been measures taken to counter the terrorism which is also termed as counter-terrorism. The atrocities in relation to the incident of 9/11 has said to changed the way the international politics and laws are conducted. Now the situation is such that nations are stereotyped and it is based on suspicion that individuals with the stereoyypical perception are arrested and interrogated as well face torture to agree what they aren't liable or accountable for. It is such instance that tends to pose a question that “Can the torture of those suspected of terrorism ever be justified?”

Before the concept of torture can be discussed it is mandatory to understand terrorism from different schools of thoughts since it is based on terrorism that torture has increased when it comes to suspected individuals who are arrested by the government on the grounds of suspicion for the conduction of terrorism (Lynch, 2007, pp. 67).

What is Terrorism?

Although the term is overused, it is still possible to give a definition of terrorism, although it is not used exactly as such by all researchers, is sufficiently similar to many current definitions that are widespread. This is a restrictive definition which focuses on the strategies and actions of terrorists and not the identity or personality of individuals, the nature of their claims or applicable laws, which will be eternally contentious aspects. It includes four key elements:

Violence or threat of violence. Accept as "terrorism" a purely intellectual or symbolically reduced our ability to analyze terrorism by diluting the definition too much. A form of physical action, or at least a credible threat of such action, must exist. Of course, the level of severity of violence is subjective. It can also be termed as presence of a political motive. For an act or a terrorist act, it is imperative that its author has committed primarily to initiate, promote, or prevent punishing conduct governmental institutional, community or industrial. This excludes individual revenge, extortion, racist attacks, any crime based on the production of financial and material profits or any act of violence to ensure continuity of these activities (Lynch, 2007, pp. 68).

Terrorism based on Asymmetry's definition can be termed as the terrorist actor is in a position of extreme power imbalance meet its primary targets. Although several states sponsoring individuals and groups engaged in terrorist activities, the context of the action of each of these groups is characterized by an asymmetry of power.
