Laws Are Made and Classified in a Number of Ways

Part 'A'

Law is a system of policies, rules and regulations which are made by the state. These laws shape up the political, economical and social system of a society. If these laws and regulations are violated, it can result in punishments and sanctions for the person who has violated them (Albert, 2005). For laws to be in place they need to be made, this can happen by using a number of different ways; U.K Parliament, Common Law and European Law. These three ways can then be divided into further categories. Goodey et al. states that,

“Law can be defined as a set of rules created by the state which forms a framework to ensure a peaceful society. If the rules are broken they can be enforced by mechanisms created by the state and sanctions imposed.”

Law is made through constitutions that give people rights but also imposes responsibilities. Although the UK's constitution is unwritten, they can be found in different sources such as Acts of Parliament, Common law and Europe. Law can be made and classified in a number of ways. Goodey et al (2008) consider Parliament, the Courts and Europe as lawmakers. They also consider methods of classifying law; Criminal v Civil and Public v Private.

Looking at the ways laws in the United Kingdom (UK) are made, and how being a member state of the European Union (EU) and a signatory to the European Convention of Human Rights (ECHR) affects those laws. The UK has an unwritten constitution, which includes Acts of the UK Parliament and judicial decisions.
