Introduction

The basic aim that this paper serves to achieve is to discuss personal events/and situations that an individual is involved in. Moreover, the aim of this paper is to give a legal suggestions, advice and guidance that would help the victim to be able to handle and resolve the situation in an effective manner. The methodologies adapted in the paper will include stepwise execution of all the necessary and essential stages. These steps or stages includes analyzing carefully the situation of an individual, analyzing the possibility of application of any legal aspect or law on the situation, finding the relevance of the situation with the laws, planning an effective strategy of milestones to be achieved and involving the relevant concerned personnel and at last the consequences that may occur if the outcome of the legal procedures is against the expectation.

The paper highlights a case that involves a disagreement between an employer and employee regarding the working hours of the job. The employee in this case is suggested by her social circle to carry a legal procedure regarding her situation. However, the victims decide to take first, a proper legal advice regarding the status of the case. Therefore, this journal provides the necessary legal guidance to the victim.

Analysis

Case Scenario

The paper highlights the conflicts between the employee and employer in a restaurant. The basis of the agreement is the difference in opinion regarding the working hours of the job. The victim works there as a waitress. It's been three months since she has been working for 80+ hours a week. However, on demanding a new work schedule from her boss, her working hours are reduced to 10 hours per week. She is advised by her acquaintance and friends to sue her boss. She, however, considers taking a proper legal advice before starting any legal action or procedure against her boss. Therefore, it can be said that the conflict between the parties and the case is on the basis of “flexible working hours”.

Involved Parties and Their Relationships

The whole case scenario involves four parties of which two are directly involved. These two parties include the employee working in the restaurant as a waitress and her employer or boss. The other two parties not directly involved in the case include colleagues, friends and acquaintances who initially advised her to take any legal action against her boss. The forth party will be the legal adviser to the victim who will comment if there is even an application of any law on the situation. If yes, the legal expert will suggest the necessary steps to be taken in preparing a strong case against the employer.
