Abstract

In this study we try to explore the concept of Persuasive Memorandum of Canons pertaining to the Ethical violations in a holistic context. The persuasive memorandum is written by the legal person to write the points and authorities. The research describes various cases and its aspects with regard to the laws. The main focus of the research is on different laws that are applied differently on the respondents. The research also analyzes different Amendments specifically, fourth and sixth amendments and tries to gauge its effect on the cases. Finally the research describes various cases of the respondents that requested in the Court of Appeals for the second chance.

Persuasive Memorandum and Ethical violations

Introduction

The persuasive memorandum of law is the writing of points and authorities. This memorandum is written to maintain the Order to Show Cause (OSC) or the motion. The legal person has to research for writing the persuasive memorandum that is assigned by the controlling attorney. While writing the points and authorities in persuasive memorandum, the legal person has to mention the jurisdiction that is State or Federal, area of law that is civil or criminal and the specific area of law involved.

Discussion

The persuasive memorandum of law requires that the legal person writing the memorandum should do the primary and secondary research for the assignment. Secondary resources support in understanding the specifications of the law. They also give credentials to the primary resources of law (Ysursa, 2009).

The persuasive memorandum is about the case of Mr. Watson. Our client Mr. Watson belongs to a well family. Once when he returned to his home after have late shift in the office, he found his family members unconscious. On finding this he called on 911 and got the help. Afterwards, it was found out that there was gas leakage in the apartments and due to the hazardous Mono-oxide gas, the family members got unconscious. When the police officers arrived for the inquiry, they found that the gas leakage had affected other houses as well that included Mr. Watson's other house. When they searched the other house, there was found out three dolls named Diana, Amanda and Jessica. The police officer Smith recognized the name of these girls as they had been missed for long time and police department was investigating about their cases. Furthermore, police officer found the photo album of these girls rapped like a mummy. The police department again started the investigation and eventually found the dead bodies of the girls in the farm that was owned by Mr. Watson. Mr. Watson was arrested for the murder of these girls. On investigation, Mr. Watson told the jury that under the religious law act, he committed those murders.

On hearing this, the jury announced the death sentence to Mr. Watson without any parole. The family of Mr. Watson hired efficient counsel Mr. Diaz to defend him, who presented the psychiatric history of Mr. Watson to prove him suffering from mental ...
