Critical Review of the Factors that Contribute to the Justice Gap in Relation to the Prosecution of Rape

Introduction

Rape is considered one of the most violent crimes (hate crime). Rape is to embarrass someone by violence or serious threat, to have carnal knowledge or practice or to allow him to practice other lewd acts. Contrary to popular belief, rape is not just a sex crime, but a crime of violence, based on the rule and authority over the victim. Sex crimes range from fast feeling in transport to crush the most brutal rape. Rape can cause injury to life a man or a woman. Rape is usually accompanied by a high probability of being beaten, wounded, or even killed, as well as pregnant or infected with disease, sexually transmitted disease. Rape is a terrible crime against the person. A determined rapist should stop with determination. In fact, rape is most often due to the power and dominion. Rapist can happily use a bottle, a screwdriver or a leg of a chair to rape his victim. Most rapes are committed by those who know their victims, and often prepared in advance. About 50% of all such attacks occur in the victim's own home and or a hotel room. It is very difficult to prove in court charged with rape if you were at home or share a rapist with it a hotel room. It is observed in majority of cases that there is a lot of justice gap in relation to the prosecution of rape. The rape victims often become also the victims of justice gap during the prosecution.

Situations in which the victim is a man and a woman perpetrator relate primarily to contact a woman with a minor boy or the use of dependence; essentially the situations (rape of a man by a woman) are not reported (Taslitz, 1999, pp.25-31).

Blaming the victim is blaming the victim whole or in part responsible for the commission of the offense by the offender. In the context of blaming rape victims corresponds to the just world hypothesis and the belief that certain victim behaviours (such as flirting, sexually attractive appearance), may encourage the perpetrator to commit ...
