Introduction

Teachers in United States enjoy several rights related to their employment that includes a certain level of freedom, prohibition against discrimination, and a protection against Dismissal from their position to a certain extent. State constitutional provisions provide protection of these rights to the teachers. These rights are specially provided to the public schools, while private schools do not enjoy the same rights. These Public Schools are entities of the state, hence; are governed by state regulations. The main rights of the Teachers include the right of notice for termination, Freedom of expression, academic freedom and protection against unreasonable searches and seizures.

Termination Issues

Many employees working around in different organizations have to face several issues, and Termination is one of such issues. Termination issues are very complex and complicated as it creates critical issues if not properly handled. The employee can go to court or file a case against the employer against an unjust termination. The employer has to follow certain rules and regulations for terminating an employee. According to the Employment Constitutions, an Employer must give an advance termination notice to the employee for termination, especially if the employee has been working for the employer for three or more months. If this is the case, the employer must give the employee a written notice of termination (Jefferson, 1997). In the termination notice, an employer is not required to give any reason for termination. However, an employer can not terminate the employee on certain conditions, even if the employer is ready to give a written notice for termination. The employer can not terminate the employee, if the reason or notice conflicts with the rights of the employee under constitution.
